NestKeeper Terms of Use

These terms are an agreement between you and Nuggy Pty Ltd (ABN 56 249 346 022) of Toowoomba, Queensland ("Nuggy", "we", "us"), which makes NestKeeper. They cover the NestKeeper app on the web (app.nestkeeper.au), iPhone and Android, and the nestkeeper.au website. By creating an account or using NestKeeper, you agree to them. If you don't agree, please don't use NestKeeper.

Our Privacy Policy explains how we handle your personal information.

1. Early access

NestKeeper is in early access. That means:

• We decide who gets in, and we may approve or decline requests to join.
• Features may change, break or be removed, and the app may be unavailable at times.
• While we work hard to keep your data safe, data loss is possible. Keep your own copy of anything important (such as photos and records you'd need for an insurance claim).
• NestKeeper is free during early access. If we introduce paid plans later, we'll tell you before they start and you won't be charged unless you choose a paid plan.

2. Your account

• You need to be 16 or over, or have a parent or guardian's permission.
• Give us an email address you control, and keep access to it secure: anyone who can open your email can sign in to NestKeeper as you.
• You're responsible for what happens in your account.
• Tell us at hi@nuggy.au if you think someone else has got into your account.

3. Households

• You can invite other people into your home. Everyone in a home can see, add, change and delete everything in it, including photos.
• The owner of a home can remove members. Anyone can leave a home.
• Only invite people you trust, and only invite someone by email if they'd expect to hear from you.

4. Your content

• What you put into NestKeeper (item names, photos, locations, listings and so on) stays yours.
• You give us permission to store, copy, display and process your content so we can run NestKeeper for you and your household. That includes sending photos and item details to our service providers for features you use, such as AI photo recognition, value estimates and eBay listings, as described in our Privacy Policy.
• Make sure you're allowed to upload what you upload. Don't upload content that is illegal, or that infringes someone else's rights or privacy (for example, photos of other people without their permission).

5. AI suggestions and value estimates

• NestKeeper uses AI to suggest item names, categories and keywords from photos, and to give rough value estimates. Value estimates may also come from eBay listings.
• These are guesses to save you time. They can be wrong. They aren't professional valuations and shouldn't be relied on for insurance, tax, legal or sale decisions. Check them, and get a proper valuation where it matters.

6. Selling on eBay

• If you connect your eBay account and post a listing, you're the seller. The sale is between you and the buyer, and eBay's terms and policies apply.
• You're responsible for your listing: that it's accurate, that you own the item and can sell it, and that it's allowed on eBay.
• The first time you post, NestKeeper may set up simple local pickup, payment and no-returns policies on your eBay account if you don't already have them. You can change these in eBay.
• We're not responsible for eBay's service, fees, buyers or what happens after a listing is posted.

7. Fair use

Please don't:

• use NestKeeper for anything illegal or harmful;
• try to get into other people's homes or accounts, or around our security or access rules;
• overload, disrupt, scrape or reverse engineer NestKeeper, except as the law allows;
• use NestKeeper to send spam, including invites to people who haven't asked for one.

8. Our service

• We may change, suspend or stop NestKeeper or any part of it. If we're going to shut NestKeeper down, we'll give you reasonable notice and a way to get your information out where we can.
• We may suspend or close your account if you break these terms or put NestKeeper or other people at risk. Where it's reasonable, we'll tell you first.
• You can stop using NestKeeper at any time and ask us to delete your account (see our Privacy Policy).
• The NestKeeper name, logo, app and website belong to Nuggy.

9. Australian Consumer Law

Our goods and services come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.

10. Liability

To the extent the law allows:

• NestKeeper is provided "as is" and we don't promise it will always be available, error-free or that data will never be lost;
• we're not liable for indirect or consequential loss, such as lost profits, lost data or loss arising from relying on a value estimate;
• where our liability for failing to meet a consumer guarantee can be limited, it's limited to supplying the service again or paying the cost of having it supplied again.

11. Changes to these terms

We may update these terms. The date at the top shows the latest version. If a change affects you significantly, we'll tell you in the app or by email before it takes effect. If you keep using NestKeeper after that, the new terms apply.

12. Law

These terms are governed by the laws of Queensland, Australia. You and we agree to the courts of Queensland having jurisdiction.
